Court Finds Activists Guilty of Vandalism

The Warsaw-Śródmieście Regional Court issued a non-final verdict on Friday, finding the activists guilty of damaging the Siren statue. In addition to community service and fines totaling 33,000 złoty (approximately $8,100 USD) to the National Heritage Protection Fund and the City of Warsaw, the court ordered the activists to cover court costs of 1,000 złoty (approximately $250 USD).

Intentional Damage to a Historical Landmark

The court determined that the activists acted consciously and intentionally when defacing the monument. Judge Marcin Kowal emphasized the importance of protecting historical landmarks, stating they hold symbolic value and convey historical significance.

The judge noted the activists’ extensive explanations during the proceedings, suggesting they were fully aware of the statue’s status as a protected monument. The city attempted traditional cleaning methods, but only a specialized conservation program successfully removed the paint.

Freedom of Speech and the Protection of Cultural Heritage

The court addressed arguments regarding freedom of speech, clarifying that such freedoms are not absolute and are limited by the rights and freedoms of others, including the right to enjoy cultural heritage. The judge questioned whether the activists’ actions effectively contributed to raising awareness about climate change, stating, “You shout so loudly that I can’t hear what you’re saying.”

Financial Impact and Appeal Plans

Prosecutors estimated the damage to the statue, fountain, and pedestal at 361,607.36 złoty (approximately $90,000 USD), based on assessments from heritage conservation experts and stonemasons. The defense announced plans to appeal the verdict.

The Incident and the Statue’s Significance

The vandalism occurred in March 2024, when two activists from the “Last Generation” group sprayed orange paint on the 1938 Siren statue, a registered historical monument. One activist stated she did not regret her actions, arguing the statue’s value demonstrated its potential for multiple symbolic meanings.
