Małgorzata Manowska, serving as President of the State Tribunal, has been issued a 3,000 złoty penalty for not convening a full session of the tribunal by April 4th, as instructed.

The full session was intended to address legal issues related to the constitutional responsibility of Maciej Świrski, the former Chairman of the National Radio and Television Council (KRRiTV).

Case Background: Świrski’s Responsibility

The case concerning Świrski has been ongoing for over a year, marked by procedural challenges, including a request for the recusal of Judge Piotr Sak from the panel reviewing the matter. These issues led a three-member panel to request legal questions be submitted to the full tribunal.

The three-member panel subsequently mandated Manowska to convene the full session by April 4th, a directive she did not fulfill.

Legal Basis for the Fine

The tribunal justified the penalty by applying provisions from the Code of Criminal Procedure, specifically articles 285 and 287, relating to fines imposed on individuals who fail to appear when summoned or obstruct proceedings.

The tribunal determined these provisions were applicable to Manowska’s failure to fulfill her obligation to convene the session.

Delay in Świrski Case Cited

The tribunal stated that Manowska’s inaction resulted in a delay in addressing the legal questions presented on March 11th, infringing upon Maciej Świrski’s right to a timely resolution of his case.

Przemysław Rosati, presiding over the three-member panel, emphasized that the criminal procedure code’s provisions regarding fines should apply to anyone failing to meet their obligations during proceedings.
