Caretakers Charged Following Toddler’s Death in Ząbki

Two staff members at a Ząbki childcare facility have been charged with involuntary manslaughter after a two-year-old boy drowned in an ornamental pond on the property this Wednesday.

Charges Filed Against Staff

Two caretakers, aged 48 and 53, working at a childcare facility on Kwiatowa Street in Ząbki, have been charged under Article 155 of the Penal Code for involuntary manslaughter. The offense carries a potential sentence of three months to five years in prison.

Prosecutor Remigiusz Krynke of the Warsaw-Praga District Prosecutor’s Office confirmed that one suspect confessed and provided a brief statement, while the second refused to answer questions or enter a plea.

Judicial Restrictions and Autopsy Results

Both suspects have been placed under police supervision three times a week. The court has also issued an order prohibiting the women from contacting each other or any witnesses involved in the case.

A post-mortem examination performed on Friday confirmed the child’s cause of death as drowning. Forensic experts noted that there were no signs of mechanical injuries on the boy’s body.

Ongoing Investigation and Official Oversight

Investigators are currently reviewing the facility’s documentation and interviewing witnesses to determine if gross negligence occurred. The Ministry of Family, Labour and Social Policy has requested an immediate inspection by the Mayor of Ząbki.

Records from the Ząbki City Hall indicate the last inspection took place on June 12, 2025, revealing no irregularities. The ministry confirmed that the staff members held the required qualifications for childcare and first aid training. The Wołomin District Prosecutor’s Office continues to manage the investigation.
