Ombudsman Demands Transparency Over Journalist’s Arrest

The Human Rights Ombudsman has addressed the detention of journalist Leszek K., calling on the prosecutor’s office to publicly disclose the legal and factual justifications for his temporary arrest.

Ombudsman Limits and Systemic Concerns

The Office of the Human Rights Ombudsman issued a statement on Wednesday, June 10, clarifying that it lacks the legal authority to access preliminary investigation files or initiate appeals in this case. The office noted that the misuse of temporary detention remains a long-standing systemic issue in Poland.

The Ombudsman emphasized that the arrest of a journalist is a unique circumstance. Consequently, state authorities should prioritize transparency and explain the reasoning behind such a decision to the public to uphold the principles of press freedom.

Prosecutor’s Disclosure Request

Due to the investigative nature of the journalist’s work, the Ombudsman has formally requested that prosecutors provide public clarity. This includes the specific legal grounds for the detention request and an explanation as to why alternative, less restrictive preventative measures were deemed insufficient.

Criminal Allegations Against Leszek K.

The charges against Leszek K. stem from events on June 6. Authorities allege that he possessed a gas pistol and 54 rounds of ammunition without the required permit. Additionally, prosecutors suspect the journalist of sending email threats directed at the District Police Commander in Piaseczno.

Context of Previous Investigations

Leszek K. had previously reported on the Polnord scandal, frequently targeting Roman Giertych, an MP for the Civic Coalition. Giertych, who formerly served as a legal representative for Polnord, faced charges in 2020 regarding financial misconduct and money laundering. In January 2025, the Regional Prosecutor’s Office in Lublin discontinued the investigation against him.
