Civic Coalition proposes new criminal law targeting patostreamers who broadcast illegal acts and promote illegal gambling.
New Criminal Law Proposed
The project, sponsored by Monika Rosa and reported by Wirtualna Polska, suggests adding Article 255b to the Penal Code. It would impose prison sentences of three months to five years on individuals who publicly distribute content depicting illegal acts through information networks.
These acts include those against life and health, freedom or with violence; mistreatment of animals or killing; violations of bodily integrity causing humiliation; and specific offenses from the Fiscal Penal Code related to illegal gambling promotion.
Exemptions from Punishment
The same punishment would apply to those distributing content simulated to appear authentic. However, the project excludes criminal liability when acts are committed for artistic, educational, collecting or scientific purposes—except for animal mistreatment and fiscal offenses.
The legislation is scheduled to take effect 30 days after its announcement.
Recent Legal Actions
In January, the prosecutor’s office filed an indictment against Marcin F. and Bartłomiej K., known as patostreamers Kawiaq and Tucznik. According to Prok. Aleksander Duda, the men conducted broadcasts watched by tens of thousands, behaving vulgarly and obscenely toward two young women while showing contempt for social norms and belief in their own impunity.
Meanwhile, RMF FM reported that Marek M., known as Czujny, has been released. This patostreamer and former assistant to Grzegorz Braun was previously convicted, among other charges, of mistreating his pregnant partner.
