Court Overturns Asset Freeze on PiS MP Woś: A Defeat for the National Prosecutor’s Office

A Warsaw court has fully overturned the asset seizure imposed on PiS MP Michał Woś, a move legal experts are calling a major procedural setback for the National Prosecutor’s Office.

The Court’s Ruling

A lawyer confirmed the court’s decision on Thursday, May 28, via X, labeling it a defeat for the National Prosecutor’s Office. The Warsaw court fully revoked the financial security measures that had been applied to Woś.

Justice Fund Investigation

The National Prosecutor’s Office is investigating Michał Woś’s involvement in the Justice Fund scandal. Woś served as Secretary of State at the Ministry of Justice between 2020 and 2023 under Zbigniew Ziobro.

Last October, prosecutors had ordered an asset freeze against Woś, which included placing compulsory mortgages on properties, seizing bank account receivables, and impounding his vehicle.

Pegasus Spyware Allegations

Last October, the National Prosecutor’s Office filed an indictment against Woś with the Warsaw District Court. Prosecutors accuse him of exceeding his powers and failing to fulfill his duties regarding the transfer of 25 million PLN from the Justice Fund to the CBA for the purchase of Pegasus spyware.

The prosecution claims Woś misappropriated entrusted funds and acted to the detriment of the public interest, an offense that carries a potential sentence of up to 10 years in prison.

Prison Service Oversight

Authorities are also investigating Woś’s supervision of the Prison Service. The probe was launched following reports from the Director General of the Prison Service regarding irregularities in the creation of the Internal Inspectorate, recruitment processes, and financial expenditures.

The notification alleges that public officials and the former secretary of state failed to fulfill their duties. Irregularities reportedly included hiring unqualified individuals without proper recruitment procedures and granting early officer promotions in violation of the 2010 Prison Service Act.
