Krakow Surgeon Murder – Prosecutors Seek Dismissal Over Suspect’s Mental Illness

On December 11, Kraków prosecutors filed a motion to dismiss charges against Jarosław W. for killing a university hospital orthopaedic surgeon, citing a court‑psychiatric assessment that found him unable to grasp the meaning of his act.

Prosecutor’s Motion to Dismiss

Prosecutors announced that they would seek dismissal of the case with the Kraków District Court, arguing that Jarosław W. was not criminally responsible for the murder.

Court‑Psychiatric Assessment

The psychiatric evaluation concluded that the suspect lacked the capacity to understand the significance of his actions during the attack. It also recommended his placement in a psychiatric facility due to a high probability of similar future offences.

Details of the Attack

On 29 April, 35‑year‑old Jarosław W. broke into the office of an orthopaedic surgeon at the Kraków University Hospital, repeatedly stabbed the doctor and fled, resulting in the doctor’s death. Jarosław W. was a prison officer and had previously been operated on by the same surgeon two years earlier, a procedure he reportedly was dissatisfied with.
