Paweł K., a lawyer convicted of causing a crash that killed two women, has not paid any compensation to the families and is now facing a forced asset seizure.
Defense Request for Electronic Monitoring Denied
In March, Paweł K.’s defense attorney filed a request with the Łódź court for permission to serve his 18-month prison sentence under electronic monitoring, citing his place of residence. The Supreme Court will ultimately decide on the matter.
No Payment to Victims, Avoidance of Communication
Paweł K. has not made any payments to the victims’ families and is not responding to correspondence. His legal representative has announced the commencement of asset seizure proceedings.
Families Express Outrage
The families of the deceased women are reportedly outraged by K.’s actions. “He applied for electronic monitoring while simultaneously failing to execute the first and second instance rulings and not paying a single złoty to the victims,” stated attorney Karol Rogalski, representing the families.
Asset Seizure and Disciplinary Action Initiated
K. has also failed to cover court costs and is “avoiding responsibility” by not collecting his mail. The lawyer representing the families stated that they are initiating asset seizure and informing the Łódź penitentiary court to reconsider granting electronic monitoring given K.’s non-compliance.
Lawyer Suspended, Disciplinary Proceedings Pending
Paweł K. is currently suspended from practicing law. Justyna Cheda-Onisk, a spokesperson for the Łódź Bar Council, stated that the disciplinary proceedings will begin upon receipt of the full written judgment.
The Bar Council can remove a lawyer from the register if they lose their civil rights or the right to practice law based on a court ruling. A disciplinary penalty of disbarment can also be imposed.
However, a conviction alone does not automatically lead to exclusion from the bar.
Eligibility for Electronic Monitoring
According to regulations, a court can order a prison sentence to be served under electronic monitoring if the sentence is no more than 18 months and there are no obstacles to its implementation.
To be eligible, the convicted person must have a permanent residence, and any adult cohabitants must consent to the arrangement. Technical conditions for monitoring, including the availability of transmitters and recorders, must also be met.
Fatal Crash in Warmia-Masuria
Paweł K. was convicted on March 5th for causing the accident that resulted in the deaths of two women. The Olsztyn Regional Court reduced the initial sentence of two years imprisonment and a five-year driving ban to 18 months imprisonment and a four-year driving ban.
Details of the Accident
The accident occurred in September 2021 on the Barczewo-Jeziorany road. K., driving a Mercedes, allegedly violated traffic safety rules by crossing a double solid line and entering the opposite lane, colliding with an Audi 80. The driver and passenger of the Audi died at the scene.
Controversial Online Statement
The accident gained public attention when K. shortly after recorded and published a video online, stating that the crash was a confrontation between a safe car and a “coffin on wheels,” implying the victims’ vehicle was unsafe and contributed to their deaths. This statement sparked public outrage.
