Polish prosecutors have indicted Konrad K. for allegedly verbally abusing and physically assaulting an 11-year-old boy due to his skin color in Ostrów Mazowiecka.
Investigation Concluded, Indictment Filed
The District Prosecutor’s Office in Ostrów Mazowiecka has completed its investigation against Konrad K., charging him with public insult and violence against a minor based on race.
The indictment has been forwarded to the District Court in Ostrołęka.
Details of the Alleged Incident
The case concerns an incident involving an eleven-year-old boy. Prosecutor Elżbieta Edyta Łukasiewicz stated the investigation revealed Konrad K. allegedly committed the crime of public insult and violence against a minor due to the boy’s racial affiliation, with the behavior characterized as hooliganism.
Criminal Code Violations
The act has been classified under Article 257 of the Penal Code, Article 119 §1 of the Penal Code, in conjunction with Article 57a §1 of the Penal Code, and Article 11 §2 of the Penal Code.
Witness Testimony
Evidence presented by the prosecution primarily includes witness statements, including those from the child’s mother and the minor victim.
The boy’s mother testified that her eleven-year-old son was verbally abused with offensive language and then kicked twice in the thigh area, with the words clearly motivated by the child’s skin color and racial background.
Child’s Interview and Defendant’s Denial
The minor victim was interviewed in a “blue room” with a psychologist present, a procedure designed to minimize stress for the child.
Konrad K. denied the charges, providing explanations that contradicted the established facts, according to the prosecution.
Hooliganism Classification and Potential Penalties
The defendant’s behavior was classified as a hooliganistic offense, defined as an intentional attack on health, freedom, honor, bodily integrity, public safety, state or local government institutions, public order, or intentional destruction of property, committed publicly and without reason or for a trivial reason, demonstrating a blatant disregard for the legal order.
Konrad K. faces a potential prison sentence of up to 5 years if convicted. The court will determine guilt and sentencing.
