New 2026 Labor Regulations: ZUS Service Periods to Include Contracts and Self-Employment

Starting in 2026, Polish employees can count previous mandate contracts and self-employment periods toward their official work seniority, potentially unlocking extra vacation days and benefits, provided they submit the necessary ZUS documentation.

Workplace seniority reform

New regulations standardizing the calculation of work seniority now apply to all employees, whether in the private or public sector. This shift marks one of the most significant changes in the labor market in years, allowing many workers to count previously unrecognized periods, such as mandate contracts or self-employment, toward their total years of service.

The scale of this change is significant, as over 1.5 million people in Poland worked under mandate contracts in 2025, and there are over 2.9 million active businesses. These groups stand to benefit most, as these periods, which previously “did not count,” will now be recognized for labor entitlements.

Recognition of non-standard employment

ZUS confirmed that periods covered by pension and disability insurance from mandate contracts or service agreements will now be included in seniority calculations. This is a breakthrough for young professionals who spent years working on these contracts after graduation without gaining credit toward their full-time employment seniority.

By documenting these periods, employees may cross the 10-year seniority threshold, which entitles them to 26 days of annual leave instead of 20. Similar benefits apply to those who spent years running a business, as these periods of professional activity will finally be recognized for determining labor rights.

Clarification on pension impacts

There is widespread misunderstanding regarding the scope of these changes. ZUS has clarified that these new rules do not apply to pension seniority and will not impact eligibility for retirement or the calculation of retirement benefit amounts.

The adjustments are strictly limited to determining employment-related entitlements, such as annual leave quotas, seniority-based bonuses, and jubilee awards.

Procedures for documentation

The process is not automatic; employees must obtain a certificate from ZUS and present it to their employer. Certificates can be generated electronically through an eZUS account using the “stażowe” application wizard. If official documentation is missing due to its age, alternative evidence of employment may be submitted.

Employees have a specific 24-month window to document these periods and provide the certificate to their employer. For the public sector, this period begins on January 1, 2026; for the private sector, it begins on May 1, 2026. Failure to meet this deadline may result in the employer refusing to recognize these periods for employment entitlements.
