Parliamentary Committee Moves to Strip Sławomir Mentzen’s Immunity Over Flare Use

The Sejm’s Regulatory, Deputy Ethics, and Immunity Committee has voted to revoke MP Sławomir Mentzen’s parliamentary immunity following his use of a pyrotechnic flare during the Independence March.

The Police Case Against Mentzen

Sławomir Mentzen was absent from the committee session where the motion to lift his immunity, filed by National Police Chief Gen. Marek Boroń, was discussed. Ewa Pudło-Gryczka of the Police Headquarters noted that carrying pyrotechnics at public assemblies is punishable by detention, restricted liberty, or fines.

Authorities argued that Mentzen “undoubtedly” possessed and used a pyrotechnic device during the Independence March. Evidence for this, including photos and recordings, was sourced directly from the MP’s own social media profiles and party accounts.

Confederation’s Defense and KO’s Rebuttal

Representing the MP, Michał Wawer argued that the act lacked the necessary social harm threshold required for prosecution. He characterized the use of flares during the Independence Day celebrations as a legitimate expression of national pride and joy.

Committee Chair Jarosław Urbaniak (KO) rejected this defense, citing a 2020 apartment fire caused by march participants’ use of flares. Urbaniak stated that Mentzen should resolve the matter by voluntarily waiving his immunity and accepting the resulting penalty.

Mentzen’s Refusal and Procedural Critique

Mentzen has declared he will not waive his immunity, dismissing the ban on flares as a “stupid” regulation that serves as an opportunity to debate its removal. He argues that his actions constituted political activity, specifically citing a flare ignited in front of a banner demanding the return of Donald Tusk to Berlin.

The MP also criticized the pace of the proceedings. He pointed out the timeline starting from the November 11, 2025, incident to the formal arrival of documents in May 2026, questioning the administrative duration of the process.

Pyrotechnics Seized During the March

The incident occurred despite a strict prohibition on pyrotechnic devices during the November 11, 2025, Independence March. Police records show that 43 individuals were detained during the event for various offenses.

Authorities reported seizing nearly 800 flares, stun grenades, and other pyrotechnic materials, alongside several knives and machetes during the course of the demonstration.
