All payments to parent councils in Poland are voluntary, with no legal basis for enforcement or pressure, contrary to common misconceptions.
Parent Council Fees: Are They Mandatory?
The most important information for every parent is that all payments to the parents’ council are completely voluntary. No institution or person has the right to demand a transfer, and the amount of the payment is decided exclusively by the parents themselves.
Moreover, the council does not have legal grounds for enforcing fees, and any forms of intimidation or pressure are contrary to regulations.
Competencies and Real Impact on School Life
The parents’ council is an institution with broad powers that should not be a mere “silent” participant in the life of the institution. Its key tasks include:
Elections and Independence of the Body
Elections to the parents’ council take place every year during the first meeting. Each student is represented by one guardian.
It is an institution completely independent of the school administration, operating on the basis of its own regulations. This document not only determines the internal structure but also the detailed rules for spending the collected funds.
Where Do the Money from the Parents’ Council Fund Go?
Although the parents’ council does not have legal personality and cannot incur obligations, it has the right to collect funds from voluntary contributions, donations or bazaars.
These funds can be used exclusively to support the statutory activities of the school.
Personal Data Protection and Payment Lists (RODO)
A common, though illegal, practice is to publish lists of people who have paid money. According to the law, it is not allowed to reveal the names of people making payments.
This data can only be used internally for record-keeping purposes. Publicly, the council may only provide aggregate summaries of amounts that do not allow identification of specific parents. A named list cannot even reach the class teacher.
