Senate Approves Amendments to Developer Transparency Law

The Polish Senate has voted to amend the Developer Act, mandating that real estate companies publish property pricing and floor area data on the government portal dane.gov.pl in a standardized format.

The Senate voted in favor of the amendment to the act on the protection of rights of residential unit or single-family house buyers, alongside the Developer Guarantee Fund. The motion passed with 62 votes in favor, 30 abstentions, and no opposition, sending the project back to the Sejm.

Mandatory data standardization

Current regulations require developers to share property information on the dane.gov.pl portal, but the use of the Ministry of Digital Affairs’ machine-readable format remains optional. The new legislation aims to eliminate this inconsistency by making the use of a standardized data structure mandatory, which will be defined by ministerial decree.

Consumer impact and potential penalties

Proponents of the law argue that uniform data will enable consumers to compare housing prices more effectively and facilitate the development of analytical tools. Failure to comply with these disclosure requirements will be classified as a practice violating collective consumer interests, carrying a potential fine of up to 10 percent of a firm’s annual turnover.

Timeline and procedural status

The amendments introduced by the Senate are primarily of a clarifying and editorial nature. If enacted, the law is scheduled to take effect three months after its official promulgation.
