Prosecutor Anna Adamiak confirmed that the European Parliament lifted Grzegorz Braun’s immunity on November 13, 2025. Prosecutors have prepared six charges, including the unlawful imprisonment of Dr. Gizela Jagielska, insulting a public official, defamation, inciting criminal acts, destruction of property, and promoting Nazism and fascism.

Intentional Obstruction of Justice

Investigators report that attempts to serve the charges failed despite five formal summons. Prosecutors allege that Braun and his counsel intentionally delayed proceedings by leaving sessions without permission or failing to reappear after breaks, effectively acting as if they are above the law.

Application for Mandatory Detention

Because EU immunity mirrors that of Polish MPs, the prosecution must obtain explicit permission from the European Parliament to detain or arrest the lawmaker. The requested measure is specifically intended to facilitate Braun’s compulsory appearance to hear the formal charges against him.

Background of the Oleśnica Incident

In April 2025, then-presidential candidate Grzegorz Braun and his supporters forced their way into a hospital in Oleśnica, trapping Dr. Gizela Jagielska in her office. The physician was targeted for performing a legal abortion during the ninth month of pregnancy due to life-threatening complications. Additional charges stem from the destruction of an equality march photo exhibition and antisemitic remarks posted on YouTube.
