Quad Rental Owner Sentenced to Prison After Knife Attack in Zakopane

The District Court in Zakopane has sentenced a local quad rental business owner to seven months in prison for attacking a resident with a knife during a dispute over trespassing.

The Sentencing and Judicial Findings

The District Court in Zakopane sentenced the owner of a quad rental business to seven months of unconditional imprisonment for a knife attack on a resident protesting the use of private land for off-road vehicles. The ruling is not yet final.

Judge Marek Marchalewicz stated that the defendant acted intentionally and publicly while under the influence of alcohol. By striking the victim, Tomasz Gut, twice with a knife, the defendant caused lacerations to the man’s forearm and hand, exposing him to life-threatening danger.

In addition to the prison sentence, the court ordered the defendant to pay 11,000 PLN in compensation to the victim and to cover all legal costs. The defendant had pleaded guilty, and the court noted that the victim’s quick reaction prevented more severe consequences.

Aggression Over Property Rights

The incident occurred on January 19, 2025, at a rental facility in Zakopane. The court heard that the defendant approached a group of people, including the victim, while carrying a knife, shouting vulgar insults and death threats. A second individual, Kamil T., was also charged with battery against another person recording the event; his case was dismissed with a one-year probationary period.

Following the verdict, Tomasz Gut expressed satisfaction but emphasized that the core issue remains the blatant disregard for private property by tourism operators. He argued that authorities must ensure rental businesses respect local regulations and land ownership laws.

Escalating Conflict in the Podhale Region

The attack has highlighted a long-standing conflict in the Podhale region regarding the environmental and social impact of off-road vehicle rentals. Despite new local regulations introduced in municipalities like Zakopane, Poronin, and Kościeliska, disputes over the use of private and protected land persist.

The defendant’s counsel indicated that an appeal may be filed following the review of the written justification. Meanwhile, the victim’s attorney announced plans to evaluate the possibility of a separate civil lawsuit against the perpetrator.
