Legal Aid Overhaul: New System Scheduled for 2028

Poland is set to replace its current ineffective legal aid system by 2028, introducing universal access to legal information and qualified support tailored to vulnerable social groups and low-income citizens.

Why the current system is failing

The existing legal aid model, established in 2015, has proven ineffective. Despite wide availability, low public engagement and inefficient spending have prompted the Ministry of Justice and the Supreme Audit Office to mandate a comprehensive reform.

Restructuring legal information and qualified aid

The new project introduces universal access to legal information for all Polish citizens and foreign residents concerning Polish or EU law. Conversely, qualified legal aid—focused on individual legal issues—will be restricted to specific groups.

The reform eliminates general civil counseling, shifting the focus exclusively to professional legal assistance and education.

Eligibility and scope of assistance

Qualified aid is reserved for low-income individuals and specific groups, including the unemployed, victims of domestic violence, the disabled, youth aged 13-18, and political veterans. Support includes drafting legal documents, mediation, and action plans.

Quality control and organizational mechanisms

County administrators will oversee service quality, supported by a new review system conducted by professional associations. Every case of aid must be documented in a central teleinformatics system managed by the Ministry of Justice.

Financing and administration

State-funded subsidies will be allocated as follows: 90% for contractor remuneration, 7% for technical operations, and 3% for legal education. Contracts with service providers, such as law firms or NGOs, will be signed for two-year terms to ensure stability.
