According to Article 888 of the Civil Code, the acceptance of a marriage proposal is legally treated as the conclusion of a donation agreement. Under normal circumstances, if a couple simply realizes they are incompatible, the recipient is not obligated to return the ring.
Conditions for Demanding Return
A donor may demand the return of a gift if the recipient displays gross ingratitude, which involves a drastic violation of social or moral norms. Mere arguments or a simple breakdown of the relationship are generally insufficient grounds for a legal claim to retrieve the ring.
Marriage Agreements and Unjust Enrichment
A different legal interpretation emerged from a high-profile court case involving singer Dorota “Doda” Rabczewska, where the ring was viewed as a component of an agreement to marry. In this view, if the marriage does not occur, the basis for holding the gift expires, rendering the jewelry a form of unjust enrichment that must be returned.
