Minister Waldemar Żurek’s decision to suspend Judge Łukasz Piebiak follows two independent, multi-threaded investigations led by the prosecutor’s office. Evidence gathered in these cases suggests serious concerns regarding the judge’s legal and ethical conduct.
The investigations involve his alleged participation in the “hate scandal” and a separate case concerning attempted judicial fraud, where he is accused of using a forged will to claim a city-owned apartment in Warsaw valued at 475,000 PLN.
Political Background and Legal Basis
The Ministry of Justice noted that Piebiak’s tenure as Deputy Minister of Justice from 2015 to 2019 was marked by systemic efforts to undermine judicial independence. His actions were described as part of an attempt to subordinate the judiciary to political influence.
Under the Law on the System of Common Courts, a minister may order an immediate break in a judge’s duties if their conduct compromises the gravity of the court or official interests. This suspension remains valid until a disciplinary court issues a ruling, for a maximum duration of one month.
Status of Ongoing Investigations
In June 2024, the regional prosecutor in Wrocław requested that the Supreme Court lift Piebiak’s immunity regarding the hate scandal, but the court has yet to set a date for the hearing. A similar request was filed last December regarding the apartment fraud case.
Despite these investigations, Piebiak was elected to the National Council of the Judiciary (KRS) by the Sejm in May 2024. The “Lawyers for Poland” association, chaired by Piebiak, has condemned the suspension as an attempt to silence a member of the KRS and pressure the constitutional body.
Ministerial Response
Minister Żurek asserted that a member of the judiciary suspected of document forgery and property theft contradicts the judicial ethos. He emphasized that no one is exempt from accountability, as judges are expected to uphold the law and public trust.
