Minister Żurek Suspends Judge Piebiak: The Dispute Over KRS Status

Minister of Justice Waldemar Żurek has suspended Judge Łukasz Piebiak from official duties due to serious criminal allegations, triggering a legal dispute over whether this suspension also terminates his membership in the National Council of the Judiciary (KRS).

Suspension Amidst Serious Allegations

On Monday, the Ministry of Justice announced the immediate suspension of Judge Łukasz Piebiak from his professional duties. The decision was prompted by the extreme gravity of charges against the judge, which include his alleged involvement in the “heaters’ affair” and an attempted judicial fraud involving a forged testament for a property in Warsaw worth 475,000 PLN.

Minister Żurek stated that because the prosecutor’s office is conducting two independent, multi-faceted investigations that cast significant doubt on the judge’s ethical and legal conduct, he must be sidelined to preserve the integrity of the judicial system. He emphasized that there can be no “sacred cows” when it comes to upholding the law.

Conflict Over KRS Membership

Minister Żurek asserts that the suspension from judicial duties effectively bars Piebiak from participating in the National Council of the Judiciary, as his membership is inherently tied to his status as an active judge. He suggests that the KRS leadership should formalize this exclusion, though the process may require a specific resolution.

The “Lawyers for Poland” association, chaired by Piebiak, has contested this interpretation. They argue that the suspension applies only to judicial work in court and does not impact his mandate as a member of the KRS, which they describe as a constitutional role rather than a standard administrative or adjudicatory task.

Disciplinary Procedures

Under current regulations, the Minister’s order for an immediate break in duties remains in effect for up to one month, pending a decision by a disciplinary court. This body must then either formally suspend the judge or lift the order entirely.

Minister Żurek expressed hope that the disciplinary court will thoroughly examine the allegations presented by prosecutors and those circulating in the public sphere. He maintains that individuals entrusted with administering justice must be held to the highest standards of integrity.
