Prosecutors Drop “Two Towers” Investigation; Dubois Calls Giertych’s Predictions Prophetic

Warsaw prosecutors closed the investigation into the “Two Towers” project on June 25, citing a lack of evidence, prompting lawyer Jacek Dubois to praise Roman Giertych’s earlier criticism of the process.

Case Dismissal and Legal Justification

The District Prosecutor’s Office in Warsaw closed the inquiry on June 25. Spokesperson Piotr Antoni Skiba stated that official details regarding the decision remain withheld until the resolution is translated into German.

Unofficial reports suggest the case was dismissed under Article 17, paragraph 1, point 1 of the Code of Criminal Procedure, which applies when an act has not been committed or evidence of a crime is insufficient.

Reactions from Legal Counsel

Jacek Dubois, representing Austrian businessman Gerald Birgfellner, stated that his client is unaware of the specific motives behind the prosecutor’s decision. Dubois noted that Roman Giertych, who previously represented Birgfellner, had been correct in his critical assessments of how the prosecution handled the case.

The Two Towers Investigation Background

The investigation into the unrealized skyscraper project on land owned by the PiS-linked company Srebrna began in February 2025. Prosecutor Małgorzata Szeroczyńska, who recently led the case, was responsible for the decision to discontinue the proceedings.

On June 10, Jarosław Kaczyński testified as a witness in the case, undergoing a nine-hour interrogation. The investigation focused on potential fraud involving the inducement of Gerald Birgfellner into unfavorable property arrangements.
