Giertych Challenges Prosecution Decision to Discontinue “Two Towers” Investigation

The Warsaw District Prosecutor’s Office has closed the investigation into the “two towers” project, prompting legal representative Roman Giertych to announce a formal appeal against the decision.

On Tuesday, the Warsaw District Prosecutor’s Office announced the closure of the investigation regarding the “two towers” project. Spokesperson Piotr Antoni Skiba stated that details regarding the justification for this decision will be withheld until a German translation of the formal ruling is completed.

Allegations of Procedural Manipulation

Roman Giertych, representing Austrian businessman Gerald Birgfellner, sharply criticized the decision and the recent change of the prosecutor in charge. Giertych characterized the replacement of Ewa Wrzosek with Małgorzata Szeroczyńska as a blatant manipulation by the prosecution, noting that the case had been transferred following public disputes.

Legal Strategy and Future Appeals

Giertych confirmed he is filing a formal complaint against the closure of the investigation. He argued that the current state of the prosecution requires intervention by the Constitutional Tribunal to ensure legal accountability, warning that failure to reform these structures allows for continued impunity for alleged fraud and abuse.

Jacek Dubois, also representing Birgfellner, confirmed that his client was not privy to the specific reasons for the prosecution’s decision. He expressed support for Giertych’s previous assessments, noting that the attorney had correctly predicted the investigation’s outcome based on the prosecution’s conduct.

Case Background

The investigation, launched in February 2025, focused on the unrealized plan to build two skyscrapers on land owned by the Srebrna company, which has ties to the PiS party. Prosecutors examined whether Gerald Birgfellner was misled into unfavorable financial arrangements regarding the project. Jarosław Kaczyński, who provided testimony in the case, reportedly answered all questions during a lengthy hearing held in June.
