The decision was announced by judge Anna Ptaszek, the court’s spokesperson for criminal cases. The three-judge panel, consisting of Adam Chocholak, Danuta Grunwald, and Anna Szymacha-Zwolińska, ruled that the most significant allegations against the former minister—specifically those involving substantial damage to the State Treasury—are sufficiently substantiated.
The court affirmed that grounds for detention, including risks of tampering with evidence, flight, and hiding, have been met. The judges clarified that this ruling does not determine guilt or innocence at this stage of the proceedings.
Extradition Plans and Defense Position
Prosecutor Piotr Woźniak announced that a formal extradition request for Ziobro, who is currently reported to be in the United States, will be prepared immediately. While the defense maintains the charges are politically motivated, the court noted that eight of the allegations were deemed insufficiently evidenced, though these were considered of lesser importance.
Investigation Into the Justice Fund
The charges against Ziobro are central to an investigation into the management of the Justice Fund during the Law and Justice (PiS) government. Prosecutors allege Ziobro committed 26 offenses, including directing an organized criminal group and abusing his office to influence grant allocations and violate legal procedures.
Procedural Background
The original detention order was issued on February 5 by the District Court for Warsaw-Mokotów. Following this, a search warrant and an application for a European Arrest Warrant (EAW) were initiated. Parallel legal disputes regarding the composition of the benches and the suspension of the EAW proceedings remain ongoing before higher judicial instances.
