Court Denies Pretrial Detention for Driver Involved in Fatal Crash That Killed Two Children

A 28-year-old driver who allegedly caused a tragic multi-vehicle collision resulting in the deaths of two children in Poland’s Łódź Voivodeship has avoided pretrial detention.

The tragic events occurred on Saturday, July 25, at around 6:00 PM on national road DK-74 in the village of Wójcin near Paradyż, in the Łódź region. According to preliminary findings, 28-year-old Agata G., driving a Toyota Yaris, changed lanes and failed to yield to the driver of a Peugeot 5008 who was overtaking another car in the left lane.

The Toyota struck the Peugeot, causing it to collide with the side of a properly traveling Nissan Qashqai. The driver of the Peugeot then lost control of the car, veered into a ditch, rolled over, and hit a tree, while the Nissan also ended up in the ditch. Two children aged 8 and 11, traveling in the back seat of the Peugeot, died at the scene, and the driver was injured alongside the driver of the Nissan and two of his passengers.

Charges Filed Against the 28-Year-Old

The prosecutor’s office has already obtained a preliminary opinion from a road traffic expert. Based on this opinion and the evidence gathered so far, 28-year-old Agata G. has been charged with causing a road traffic accident resulting from the unintentional violation of safety rules.

The woman did not plead guilty to the charge.

Court Rejects Pretrial Detention Request

Simultaneously, the District Prosecutor’s Office in Opoczno requested the court to apply a three-month pretrial detention against the woman. The submitted motion was justified by the need to secure the proper course of the proceedings, the risk of a severe prison sentence facing the suspect, and the necessity to carry out a series of procedural actions in the case, according to a statement from the Regional Prosecutor’s Office in Piotrków Trybunalski.

However, the District Court in Opoczno decided not to arrest the woman, instead applying police supervision, a ban on leaving the country combined with the retention of her documents, and financial bail.
