Conditions for Vacation Payouts
Many employers require employees to take at least 14 consecutive days of leave to qualify for the “wczasy pod gruszą” (holiday under the pear tree) bonus. While this is common practice, it is not always legally compliant. Whether an employer can deny this benefit depends on internal ZFŚS regulations and the overarching provisions of the ZFŚS Act.
Legislative Framework and Internal Rules
The ZFŚS Act does not mandate a specific number of leave days to receive benefits. Consequently, there is no statutory requirement for a 10, 14, or 21-day leave period. However, employers may establish such criteria in their ZFŚS regulations, provided those rules do not conflict with the law.
The Primacy of Social Criteria
Article 8, paragraph 1 of the ZFŚS Act dictates that benefit allocation must depend on the life, family, and financial situation of the employee. Length of leave cannot replace these social criteria. An employer cannot automatically grant the same bonus to all employees solely based on their vacation duration without assessing their individual material needs.
Judicial Precedent
Courts have consistently ruled that automatic, indiscriminate distribution of ZFŚS funds is unlawful. In its judgment of August 16, 2005 (case file I PK 12/05), the Supreme Court affirmed that bypassing social criteria when granting benefits violates the ZFŚS Act. Regulations requiring only a specific leave duration for payout eligibility are therefore insufficient and legally contestable.
Distinction from Statutory Holiday Benefits
It is essential to distinguish “wczasy pod gruszą” from the statutory holiday benefit defined in Article 3, paragraphs 4–6 of the ZFŚS Act. In the case of the statutory holiday benefit, the 14-day leave requirement is explicitly mandated by law, unlike the internal social fund bonus.
