Fatal Crash Near Bisztynek: Prosecutors Drop Drunk Driving Charge Despite 1.5 Promile Reading

Prosecutors have dropped the charge of driving under the influence against Alan G., who had 1.5 promile of alcohol after a fatal August 2025 crash near Bisztynek, following expert retrospective analysis.

The Evidence and Legal Dismissal

Following a fatal accident near Bisztynek, 35-year-old Alan G. was found with approximately 1.5 promile of alcohol in his system. However, the prosecutor’s office has closed the investigation into driving under the influence. Two independent expert opinions on retrospective testing could not rule out the suspect’s claim that he consumed the alcohol only after the collision occurred.

Despite this dismissal, Alan G. remains in custody and faces up to 20 years in prison. The remaining charges, which carry significant weight, include causing a fatal traffic accident, fleeing the scene, and failing to provide assistance to the victims.

Tragedy on the Road

The incident occurred on August 15, 2025, at approximately 9:36 PM on the route between Bisztynek and Wozławki. An Audi driven by Alan G. rear-ended a Skoda carrying a family just one kilometer from their home. The impact killed 37-year-old Zbigniew M., a soldier and volunteer firefighter, and his two-year-old son, Hubert.

Samanta B., the mother of the child and partner of Zbigniew M., sustained critical injuries. At the time of the crash, she was in an advanced stage of pregnancy; medical staff were able to save both her and the infant.

Fleeing the Scene and Defense Strategy

Immediately after the collision, the driver of the Audi abandoned the victims and fled on foot to his residence, where he was later apprehended by police. While Alan G. partially admitted to the charges, he consistently denied being intoxicated at the time of the crash, attributing his alcohol consumption to post-accident stress.

The prosecutor’s decision to drop the DUI charge does not imply that the suspect’s behavior was deemed acceptable. Rather, it reflects the legal inability to conclusively disprove his version of events in the absence of definitive contradictory evidence, which is a requirement for a DUI conviction under criminal law.
