Former NIK President Marian B. Indicted Over Tax Secrecy Breach

The Regional Prosecutor’s Office in Białystok has filed an indictment against former Supreme Audit Office (NIK) President Marian B. and two others for allegedly soliciting the disclosure of protected tax information.

Indictment Details

The Białystok Regional Prosecutor’s Office has referred the indictment against Marian B. and two co-defendants to a Krakow court. The charges include soliciting officials from the National Revenue Administration to disclose information protected by tax secrecy to unauthorized persons.

Tadeusz G., the former director of the Tax Administration Chamber in Krakow, has been charged with revealing confidential tax information obtained during his official duties. Prosecutors state this disclosure facilitated an individual’s attempt to evade criminal responsibility.

Charges Against NIK Officials

Marian B. faces charges of soliciting Tadeusz G. to leak confidential data. Tadeusz G., who faces a total of six charges, has confessed to providing Marian B. with information regarding tax audits and investigations conducted by the Central Anti-Corruption Bureau (CBA).

The indictment also includes Beata O., the former director of the NIK delegation in Warsaw. She is accused of soliciting a public official to commit a prohibited act, specifically the disclosure of tax secrets and abuse of power to the detriment of public interest.

Investigation History

The investigation, initiated in 2019 following reports from the CBA, the General Inspector of Financial Information, and a group of parliamentarians, originally focused on false financial statements and unreported income from rental properties.

In 2021, the probe expanded to include the former NIK president’s son, Jakub B., and his wife, Agnieszka. They were accused of attempting to defraud the National Fund for the Restoration of Krakow Monuments and VAT tax evasion, charges to which they have pleaded not guilty. Marian B. also denies all allegations against him.
