Indictment Filed Against Antoni Macierewicz Over Sejm Remarks Labeling SKW Leaders Russian Agents

Warsaw prosecutors have filed an indictment against former Defense Minister Antoni Macierewicz for publicly insulting and defaming the leadership of the Military Counterintelligence Service in Parliament.

Indictment Filed Against Former Defense Minister

The Regional Prosecutor’s Office in Warsaw has submitted an indictment against Antoni Macierewicz to the Warsaw-Śródmieście District Court. The former head of the Ministry of National Defense faces charges over statements in which he called the leadership of the Military Counterintelligence Service Russian agents and accused them of cooperating with Russian special services.

The filing of the indictment against the PiS MP on Thursday was announced by the spokesperson for the Regional Prosecutor’s Office in Warsaw, prosecutor Mateusz Martyniuk.

Accusations of Insult and Defamation

Macierewicz was accused of insulting public officials on September 11 of last year during a public address at a Sejm session. The targeted officials included Military Counterintelligence Service chief Gen. Jarosław Stróżyk and his deputies, Col. Krzysztof Dusza and Col. Artur Pluto, due to their positions, by calling them Russian agents.

Prosecutors also charged Macierewicz with defaming the SKW leadership by accusing them of cooperating with Russian special services, which could lower them in public opinion and expose them to the loss of trust necessary for holding their positions. The offenses carry a penalty of a fine, restriction of liberty, or up to one year of imprisonment.

Context of the Controversial Sejm Statements

Macierewicz’s statements were made during a debate on information presented in the Sejm by Deputy Prime Minister and Defense Minister Władysław Kosiniak-Kamysz regarding the violation of Polish airspace by Russian drones.

According to the Sejm transcript, the PiS MP stated that the leadership of the Military Counterintelligence Service consisted of Russian agents appointed by Donald Tusk in 2011. The sentence was left unfinished as it caused a commotion in the room. Macierewicz added that these individuals were once again heads of the service and questioned how long they would be tolerated and supported.

Political Reactions and Immunity Waiver

The notification to the prosecutor’s office was submitted by the leadership of the SKW. The former defense minister claims the charges are political in nature and expressed surprise at the prosecutor’s actions during an April meeting of the parliamentary rules committee.

The Sejm lifted Macierewicz’s immunity in this case at the end of April this year. Minister of Justice and Prosecutor General Waldemar Żurek emphasized in response to the indictment that in a democratic state ruled by law, no one stands above the law, and anyone making such serious public accusations must be ready to face accountability before an independent court.
