Kacprzyk’s Counsel Threatens Criminal Action Against Jędrzejewski

Attorney Jacek Dubois has issued a formal demand for former surgery department head Emil Jędrzejewski to retract his allegations regarding patient deaths or face an imminent criminal lawsuit.

Jędrzejewski summoned to prosecutor’s office

The former surgery department head arrived at the prosecutor’s office around 12:30 PM. He declined to answer journalists’ questions concerning evidence for his public claims about patient fatalities, stating he had nothing further to add as he entered the building.

Demands for public retraction

Attorney Jacek Dubois, representing Dawid Kacprzyk, stated that his client rejects all accusations made by the former department head. Dubois warned that if Dr. Emil Jędrzejewski does not retract his defamatory and false statements within the coming hours, a criminal trial will follow.

Dubois argued that Jędrzejewski’s comments undermine Kacprzyk’s professional credibility and hold him responsible for patient deaths without any factual basis. He reiterated that a serious criminal case will be launched immediately if a retraction is not issued.

Defense against allegations of malpractice

Addressing specific incidents, Dubois clarified that a tomography scan performed on a deceased patient occurred before Kacprzyk was employed at the Southern Hospital, and it was a standard procedure to determine the cause of death. Regarding other patient deaths, the attorney noted that the prosecutor’s office has been investigating these cases for some time, pointing to potential negligence by emergency paramedics rather than his client.

Dubois firmly denied that his client had falsified medical records or committed medical malpractice. He claimed Jędrzejewski never participated in or witnessed the medical procedures performed by Kacprzyk and is making accusations without having access to proper information.

Escalating hospital conflicts

Kacprzyk’s counsel suggested the accusations stem from a long-standing conflict between the two doctors, intended to portray Jędrzejewski as a whistleblower following his dismissal. He acknowledged that Kacprzyk had encouraged patients to file complaints against the former head regarding excessive wait times and the delegation of consultations to inexperienced staff.

Prosecutorial review of medical procedures

Jędrzejewski’s testimony follows a recent interview where he claimed that the Southern Hospital’s emergency department suffered from improper procedures, medical errors, and falsified documentation. He alleged that errors led to fatal complications.

Minister of Justice and Prosecutor General Waldemar Żurek announced that the prosecutor’s office is analyzing 32 cases concerning the Southern Hospital dating back to 2023, including 12 cases involving patient deaths. Authorities intend to review these files and secure the evidence pointed out by Jędrzejewski.
