Minister Suspends Judge Piebiak: Legal Dispute Over KRS Status Erupts

Minister of Justice Waldemar Żurek has suspended Judge Łukasz Piebiak from judicial duties due to serious allegations, triggering a heated legal dispute over whether this suspension also removes him from the National Council of the Judiciary (KRS).

The Grounds for Suspension

On Monday, Minister of Justice Waldemar Żurek announced the immediate suspension of Judge Łukasz Piebiak from his official duties. The decision stems from the extraordinary weight of allegations currently under investigation by the prosecutor’s office.

The investigations concern two separate matters: the judge’s alleged involvement in the so-called “haters’ affair” and an alleged attempt at judicial fraud involving a forged will for a property in Warsaw worth 475,000 PLN.

Conflict Over KRS Membership

Minister Żurek maintains that the suspension from judicial duties effectively bars Piebiak from performing functions within the National Council of the Judiciary (KRS). The Minister argues that because Piebiak’s seat in the KRS is tied to his status as a judge, his suspension renders him ineligible to continue serving in the Council.

Conversely, the “Lawyers for Poland” association, led by Piebiak, argues that the suspension cannot override a constitutional mandate. They contend that the role of a KRS member is not a standard judicial duty and that the executive branch lacks the authority to manually dictate the composition of this constitutional body.

The Procedural Path Forward

Under current regulations, the Minister’s immediate suspension is valid for up to one month, pending a decision by the disciplinary court. This court must decide whether to formally suspend the judge or lift the Minister’s order before the initial period expires.

Minister Żurek has stated his hope that the disciplinary court will thoroughly address all allegations appearing in both the prosecutor’s files and the public sphere, emphasizing that even those tasked with upholding the law must be held accountable for their actions.
