Some pensioners are receiving up to 62,000 PLN in retroactive payments and increases of nearly 3,500 PLN per month following favorable pension recalculations. While seniors are winning cases against ZUS in court, the current government proposal (UD204) may not fully resolve the systemic issue.
The dispute centers on individuals who retired early, only to have their pension capital reduced by the state when calculating their standard retirement age benefits. The law was changed after they had already made their retirement decisions, leading to significant financial losses for many.
ZUS Warns of Wider Legal Scope
The official position of ZUS indicates that the problem extends beyond the cohorts specifically mentioned in the proposed legislation. The institution explicitly highlighted younger miners who retired before June 6, 2012, as well as individuals who acquired rights to artistic or creative retirement benefits before that date.
ZUS emphasized in its official opinion that these groups are in the same legal situation as those covered by the draft act. This admission raises questions about whether the future law will comprehensively include all affected individuals or if further litigation will be required.
Constitutional and Legal Context
The significance of the June 6, 2012, date stems from the enactment of regulations that allowed ZUS to deduct previously paid benefits from future pensions. In a judgment dated June 4, 2024 (case file SK 140/20), the Constitutional Tribunal questioned the application of these rules to those who retired before that date.
ZUS has also warned that the proposed bill could create new inequalities. Specifically, it noted that individuals who have not yet applied for standard-age pensions might face less favorable calculation methods than those already receiving them, potentially creating further disparities among beneficiaries.
Next Steps for Affected Pensioners
While the proposal estimates that 175,200 people could be affected, the total number of individuals impacted may be higher. There is currently no definitive public response from the Ministry of Family, Labor and Social Policy regarding the inclusion of the additional groups identified by ZUS.
Pensioners are advised to review their retirement decisions, specifically the dates, legal bases, and calculation methods used by ZUS. Because individual circumstances vary, the financial outcome of any potential recalculation depends entirely on an individual’s specific employment history and capital contributions.
