Request Sent to the Marshal of the Sejm
Prosecutor General Waldemar Żurek transmitted a request to the Marshal of the Sejm to grant consent for the detention and compulsory bringing of MP Michał Woś to the prosecutor’s office.
The National Prosecutor’s Office stated that evidence has been gathered sufficiently justifying the suspicion that Michał Woś committed an offense involving the abuse of powers and failure to fulfill duties as a public official while serving as Secretary of State in the Ministry of Justice.
Background in the Ministry of Justice
Woś, during the tenure of Zbigniew Ziobro, was responsible in the Ministry of Justice for matters related to the Prison Service and the Internal Inspectorate of the Prison Service.
The prosecutor’s office noted that Michał Woś was summoned four times to appear at the Regional Prosecutor’s Office in Poznaniu, but he never showed up.
Waiver of Immunity
As an MP, Michał Woś possesses immunity protecting him from law enforcement. In February of this year, Waldemar Żurek directed a letter to the Marshal of the Sejm requesting consent to hold Woś criminally liable based on the Act on the Exercise of the Mandate of a Deputy and Senator, as well as Article 105, Paragraph 2 of the Constitution.
In May, Włodzimierz Czarzasty forwarded Michał Woś’s statement to the prosecutor general, in which the MP himself waived his parliamentary immunity, formally consenting to criminal liability being pursued against him by the Regional Prosecutor’s Office in Poznaniu.
Current Legal Steps and Detention Status
A communiqué on the National Prosecutor’s Office website indicates that a decision has been issued to present charges and that all legally required actions have been undertaken aimed at serving them to Michał Woś and questioning him as a suspect.
Addressing why the MP has not yet been detained, the prosecutor’s office explained that the formal waiver of immunity does not automatically mean consent for the detention and compulsory bringing of the politician before the prosecutor.
