Prosecutors Decline to Open Defamation Case Against Sikorski Over Macierewicz Remarks

Poland’s Foreign Minister Radosław Sikorski will not face criminal defamation charges after calling opposition politician Antoni Macierewicz a “nutcase” during a parliamentary debate regarding national security concerns earlier this year.

The Prosecutor’s Decision

The District Prosecutor’s Office in Warsaw announced it will not initiate proceedings regarding the defamation complaint filed by PiS MP Bartosz Kownacki. Prosecutors noted that defamation is a private prosecution offense and there is no public interest requiring state intervention.

The decision, issued on June 10, emphasizes that Antoni Macierewicz is fully capable of pursuing private legal action himself, given his extensive experience with successful litigation in the past.

Concerns Over Parliamentary Standards

The prosecutor’s office acknowledged that Sikorski’s remarks were beneath the standards of dignified communication and failed to uphold the gravity of the state. However, they deemed this insufficient to justify a public prosecutor’s involvement.

Furthermore, officials noted that Sikorski has frequently used the term “nutcase” to describe Macierewicz over the last decade without triggering legal action, suggesting it is inappropriate for the prosecutor to intervene now when the alleged victim previously chose not to act.

Remaining Legal Avenues

The closure of this investigation does not prevent Macierewicz from pursuing the matter personally. He retains the right to file a private indictment with the court if he wishes to seek criminal accountability for the insult.

Following the incident, Macierewicz suggested legal repercussions would follow, while Sikorski publicly responded on social media by stating he would retract the term in court only if Macierewicz admitted to harming Poland on orders from others.
