Investigation Launched into Illegal Waste Disposal
The District Prosecutor’s Office in Pruszków initiated an investigation on August 8, 2026, following events that occurred the previous day at a private property in Milęcin within the Brwinów commune. Investigators established that chemical waste contained in 1,000-liter IBC containers was to be disposed of by pouring the liquid directly into an excavated trench in the ground.
Piotr Antoni Skiba, the press spokesman for the District Prosecutor’s Office in Warsaw, stated that two containers of liquid had been poured into the trench based on current findings.
Execution of the Procedure and Suspects
According to the prosecution, suspect Dariusz P. entered into an agreement with the property owner to clean up the liquid containers on the site. He hired a man with an excavator and two additional workers to carry out the tasks.
Investigators determined that an excavator was used to dig a trench inside a hall, and the waste containers were transported toward it using a forklift. Piotr Antoni Skiba confirmed that the trench was dug inside the hall for the waste disposal, with containers transported by a forklift.
State Fire Service Intervention and Environmental Threat
A specialized chemical unit of the State Fire Service was called to the location to neutralize the contamination and secure samples of the substances for detailed physicochemical testing. Preliminary findings indicated the retrieved material contained engine oil and other petroleum-derived liquids.
The Warsaw District Prosecutor’s Office stated that these wastes could threaten human life or health and lower the quality of groundwater and soil.
Detentions and Court Decisions on Custody
On August 7, police detained four workers on the property, and the prosecutor charged all of them the following day with illegal waste handling and soil surface pollution. Two suspects with subordinate roles received police supervision, a ban on contacting witnesses and other suspects, and a ban on approaching the Milęcin property.
The prosecution viewed the role of Dariusz P. as the organizer and requested his temporary arrest from the Pruszków District Court, alongside a fourth suspect who is a Ukrainian citizen without a permanent residence in Poland. The court did not grant these temporary arrest motions, placing both under police supervision and non-contact orders, while Dariusz P. received an 80,000 PLN financial bail and the Ukrainian citizen a travel ban with his passport retained. The prosecution is analyzing the court decision for a potential appeal.
Legal Qualifications and Further Proceedings
Further proceedings will heavily rely on physicochemical tests of the secured material to determine the exact composition of the substances in the containers and those poured into the ground. The investigation follows offenses under Article 183 § 1 and Article 182 § 1 of the Penal Code.
The first provision covers unlawful handling of waste or substances that may endanger human life or health or significantly worsen environmental quality, carrying a penalty of one to 10 years imprisonment. The second provision encompasses water, air, or land surface pollution capable of threatening humans, lowering environmental quality, or causing significant damage to plant or animal life, punishable by six months to eight years in prison.
