Prosecutors Urge EAW for Ziobro, Citing Likely Return from US

The National Prosecutor’s Office has informed the Warsaw Regional Court that Zbigniew Ziobro is currently in the United States, arguing an European Arrest Warrant remains essential should he return to the EU.

Status of the European Arrest Warrant

On June 11, 2026, the Warsaw Regional Court requested information from the National Prosecutor’s Office regarding the current location of suspect Zbigniew Ziobro and whether he remains within the European Union.

The court is reviewing a February 10, 2026, request for an European Arrest Warrant (EAW) concerning irregularities in the Justice Fund. At the time of the initial request, Ziobro was in Hungary, but he later departed the EU. Despite multiple requests from prosecutors to schedule a hearing, the court had not yet acted on the motion.

Current Findings and Legal Rationale

Regulations stipulate that an EAW can only be issued if there is a suspicion that the subject is located within an EU member state; otherwise, the request must be dismissed. On Friday, the Prosecutor’s Office informed the court that investigations confirm Ziobro has been in the United States since May 9, 2026.

Prosecutor Przemysław Nowak stated that an EAW remains necessary to detain the suspect if he returns to EU territory. The office considers such a return probable, noting that Ziobro has historically lived, worked, and received medical treatment within the EU, with Belgium listed as his declared permanent residence.

According to RMF FM, defense attorney Bartosz Lewandowski has submitted an original statement to the court from his client confirming his presence in the United States. A judicial decision regarding the warrant is expected soon.
