Bureaucratic Hurdles for Allotment Holders
Rising maintenance costs and frequent droughts have prompted many family allotment garden (ROD) users to consider building their own wells. While this offers independence from the garden water supply, it involves formal and technical requirements that, if ignored, can lead to severe financial consequences.
Unlike private property owners, allotment users do not own the land. They hold rights to the plot, but the garden association remains the legal owner of the site. Therefore, building a well requires explicit consent from the garden management board, which may dictate the location or reject the project entirely to protect shared infrastructure.
Legalization Obligations and Water Regulations
Polish water management authorities note that while some cases of water usage do not require a water permit, this is often misinterpreted as a complete lack of formal obligations. Every well on an allotment must be legalized in accordance with current regulations to avoid administrative issues or disputes over water resources.
Strict Technical and Spatial Standards
The location of a well cannot be arbitrary. The Polish Allotment Gardeners Association mandates specific distances from property boundaries, sanitary facilities, and waste tanks to prevent contamination. Furthermore, a well must not interfere with underground utility lines or pathways; failure to adhere to these technical standards may result in a denial of construction permission.
Financial Risks of Illegal Wells
The consequences of non-compliance are severe. Unauthorized well construction can trigger fines of up to 5,000 PLN, along with potential court-ordered penalties. Beyond fines, owners may be forced to dismantle the installation at their own expense and restore the land to its previous state. In extreme cases, the garden board may terminate the user’s right to the allotment entirely.
