Tusk Lines Up Giertych: “No Sacred Cows, If He Broke the Law – He Is Out”

Prime Minister Donald Tusk declared that Civic Coalition MP Roman Giertych will face immediate consequences and an investigation if found responsible for an illegal recording leak.

Leak After the PiS Leader’s Hearing and the Prosecutor’s Decision

If it turns out that MP Roman Giertych broke the law, for example by illegally removing recordings from the hearing of PiS leader Jarosław Kaczyński regarding the “two towers” case, he will face consequences, Prime Minister Donald Tusk assured on Wednesday. He announced that he would ask the Prosecutor General for a stance on the matter.

Last week, the portal goniec.pl published video recordings on YouTube showing fragments of Kaczyński’s multi-hour hearing at the Warsaw District Prosecutor’s Office. The PiS leader was heard on June 10 of this year as a witness in the “two towers” case, which the prosecutor’s office dismissed two weeks later due to a lack of elements of a prohibited act.

The Prosecutor’s Office Points to the Attorney and Initiates Actions

Following the video publication, the District Prosecutor’s Office in Warsaw announced it was taking steps regarding the release of recordings that constitute an attachment to the witness hearing protocol. The office noted that the only person who requested access to the entire case file was one of the victim’s attorneys, who had been previously instructed on the confidentiality of preparatory proceedings.

The prosecutor’s office sent a letter to the Warsaw Bar Association and materials to the Regional Prosecutor’s Office in Warsaw, which transferred the case to the Warsaw-Praga District Prosecutor’s Office.

“Not a Sacred Cow”: Tusk Announces Immediate Investigation

During a Wednesday press conference, when asked whether Giertych shared the recordings, Tusk emphasized that if it turns out the MP did anything illegal, he will naturally bear the consequences.

Tusk stated he did not get the impression that the prosecutor’s office officially stated Giertych was responsible for illegally removing documents, adding that he would ask the Prosecutor General directly and expects an immediate investigation if that is the case. He described Giertych as someone who is accomplished in some matters and controversial in others, concluding that he is not a sacred cow and is out if he broke the law.

Last week, Giertych argued in an interview with “Fakt” that targeting him is unjustified, claiming the leak came from the prosecutor’s office and calling their official statement arrogant. He also criticized the prosecutor for handling the hearing and dismissing the case.

Dispute Over Dismissed Questions and the Finale of the “Two Towers” Investigation

Prosecutor Skiba stated that the majority of Giertych’s questions—8 out of 11—were dismissed, though the victim had two other attorneys who asked nearly 70 questions combined. The investigation, which ran from February 2025 regarding plans to build two skyscrapers on a plot belonging to the Srebrna company, was dismissed on June 25.

The investigation concerned leading Austrian businessman Gerald Birgfellner to disadvantageous disposition of property of great value between May 2017 and July 2018. The victim’s attorneys have filed an appeal against the dismissal.

The Minister of Justice Comments on the Leak

Minister of Justice and Prosecutor General Waldemar Żurek refrained from evaluating whether Roman Giertych was behind the removal of the files, stating that prosecutors should exercise restraint in their statements until formal charges are brought. He agreed with the Prime Minister that there are no sacred cows and noted that he had not yet spoken with the head of government on the matter.

Żurek also assessed that the prosecutor’s office still includes many individuals from former minister Zbigniew Ziobro’s tenure, leading to deliberate leaks aimed at weakening prosecutorial actions or destroying nascent investigations, which trigger criminal proceedings when evident.
