Warsaw Prosecutors Drop “Two Towers” Investigation

The Warsaw District Prosecutor’s Office has closed the high-profile investigation into the failed “Two Towers” construction project involving the Srebrna company, citing a lack of evidence that a crime occurred.

The Decision to Close the Case

On June 25, the Warsaw District Prosecutor’s Office officially discontinued the investigation into the “Two Towers” project, which centered on plans to build skyscrapers on land owned by a company linked to the PiS party. Prosecutors determined that the actions under scrutiny did not constitute a prohibited act.

The investigation was initially overseen by prosecutor Ewa Wrzosek, but the final decision to close the case was issued by Deputy District Prosecutor Małgorzata Szeroczyńska. The case included allegations regarding the financial treatment of Austrian businessman Gerald Birgfellner and potential misconduct within the Lech Kaczyński Institute Foundation.

Official Stance on Independence

Warsaw Regional Prosecutor Małgorzata Adamajtys issued a statement emphasizing that the decision was made by an independent prosecutor based solely on evidence, regardless of political or media pressure. She added that if the decision is appealed, it will be evaluated by an independent court.

National Prosecutor Dariusz Korneluk also voiced opposition to public criticism of the case, labeling attacks on the prosecutor’s decision as an attempt to undermine the foundational principles of a democratic state governed by law.

Legal Appeals and Political Controversy

Roman Giertych, representing Gerald Birgfellner, announced he would appeal the closure of the investigation. Giertych criticized the removal of Ewa Wrzosek from the case and expressed skepticism about the impartiality of the judicial system under current regulations.

The investigation into the “Two Towers” gained significant attention, involving witness testimony from PiS leader Jarosław Kaczyński and investigations into the death of Barbara Skrzypek, a long-term associate of Kaczyński. Authorities previously ruled out third-party involvement in her death, attributing it to a heart attack.
