New Polish Labor Code regulations from January 27, 2026 clarify vacation payment deadlines and mandate electronic documentation for HR matters.
End of Uncertainty: When Will You Receive Vacation Pay?
Until now, the deadline for payment for unused leave days was controversial. New regulations (Article 171 of the Labor Code) precisely define two scenarios.
HR Matters Now Handled Via Email
From January 27, 2026, the obligation of paper form disappears in many key matters. Now it is enough to send an email (with data allowing to identify the sender) or a document with a qualified electronic signature to handle various HR matters.
Can an Employer Refuse to Pay the Equivalent?
The obligation to pay arises automatically on the day the contract ends if you have not used your vacation. However, there are two exceptions.
Warning About Terminations!
Despite digitalization, the Labor Code still imposes strict requirements when dismissing employees. The termination of a contract still requires written form (handwritten signature). If you want to do it digitally, you must use a qualified electronic signature – a simple scan or email may be considered a violation of procedures.
Changes in the Social Fund (ZFŚS)
That’s not all. New regulations strengthen the voice of employees. From now on, regulations of the social fund must be consulted with at least two representatives of the workforce, not one, as was the case until now.
