Polish Judges Schedule Oath-Taking Despite Presidential Opposition

Four Constitutional Tribunal judges, blocked from taking office by President Karol Nawrocki, have scheduled an oath-taking ceremony in the Sejm on April 9, 2026.

Judges Invite President to Oath-Taking Ceremony

The oath-taking of four judges – Krystian Markiewicz, Marcin Dziurda, Maciej Taborowski, and Anna Korwin-Piotrowska – is scheduled for 12:30 PM on Thursday in the Sejm. President Karol Nawrocki has been invited to the ceremony, though his attendance is unlikely.

Attempts to Complete the Process

The four judges, selected by the Sejm, reminded the President of their previous unsuccessful attempts to complete the oath-taking process in letters dated April 7, 2024. They had previously sent correspondence on March 26 and April 1.

Formal Invitation and Legal Basis

In a letter to the President, each judge formally invited him to the Sejm on April 9, 2026, at 12:30 PM to witness their oath-taking, citing Article 4 and 5 of the November 30, 2016 Act on the Status of Constitutional Tribunal Judges (Journal of Laws of 2028, item 1422). They emphasized their obligation to immediately begin their service and the fundamental importance of a functioning Constitutional Tribunal for protecting citizens’ rights and freedoms.

Dispute Over Oath-Taking Procedure

The letter does not specify how the oath-taking will be conducted. The most likely scenario involves the judges swearing their oath before the Marshal of the Sejm, with the record of the oath later sent to the President. Government representatives believe this fulfills the legal requirement of swearing the oath “before the President.”

However, the President’s Chancellery and the President of the Constitutional Tribunal, Bogdan Święczkowski, disagree. Święczkowski stated in a recent interview that while anyone can enter the Tribunal, fulfilling the statutory and constitutional conditions is necessary to enter as a judge.
