The Olsztyn Regional Prosecutor’s Office is seeking a cassation appeal against the appellate verdict for lawyer Paweł K., citing erroneous findings by the Regional Court regarding a fatal 2021 traffic accident.
Prosecutor’s Objection to Court Findings
According to Daniel Brodowski, spokesperson for the Olsztyn Regional Prosecutor’s Office, the Regional Court made factual errors concerning the circumstances of the incident. Specifically, prosecutors contest the court’s finding that the fatal crash, which claimed the lives of two women, was caused by the lawyer’s unintentional negligence.
Request for Extraordinary Appeal
Because the case does not involve a crime, acquittal, or dismissal, the Regional Prosecutor lacks the standing to file a cassation appeal directly. Instead, investigators have submitted an extensive motion to the National Prosecutor, requesting that they petition the Supreme Court to review the verdict.
The 2021 Fatal Collision
On September 26, 2021, while driving near Barczewo, lawyer Paweł K. collided head-on with a vehicle carrying two women, aged 53 and 67. Shortly after the crash, the lawyer famously dismissed the victims’ vehicle as a “coffin on wheels” in an online video, sparking widespread public outrage.
Legal Proceedings and Sentencing
In April 2023, the District Court in Olsztyn sentenced the lawyer to two years in prison and a five-year driving ban. In March 2026, the Regional Court reduced the sentence to 1.5 years and the driving ban to four years. Paweł K. was later apprehended on May 7 after failing to report to serve his sentence.
Drug Investigations and Toxicology
Paweł K. is currently held in Szczecin due to an ongoing investigation into drug-related offenses involving himself and his wife, including the possession of marijuana, cocaine, and mephedrone. During the 2021 accident, trace amounts of cocaine were detected in the lawyer’s system; he claimed the presence of the drug was accidental, potentially from a contaminated glass.
