Prosecutors have launched an involuntary manslaughter investigation after a two-year-old child drowned in a pond on the premises of a daycare facility on Kwiatowa Street in Ząbki on Wednesday.
Fatal Incident in Ząbki
The District Prosecutor’s Office in Wołomin has initiated an investigation under Article 155 of the Penal Code, which pertains to involuntary manslaughter. The tragic event occurred on Wednesday at a care facility located on Kwiatowa Street, where a group of approximately 20 children was under the supervision of two staff members.
Investigation into Negligence
Initial findings confirm that the child wandered away from the caregivers’ supervision and entered a garden pond located on the same property. The investigation is now focused on determining the exact sequence of events, identifying who held direct responsibility for the children at the time, and establishing how the toddler was able to access the hazardous area.
Detention of Staff
On Wednesday evening, authorities detained two female caregivers, aged 48 and 53. Prosecutors confirmed that both women were sober at the time of the incident. While they remain in custody, no formal charges have been filed against them at this stage of the proceedings.
Status of the Facility
The prosecutor’s office is currently investigating the formal legal status of the site. Investigators noted that, contrary to earlier reports from the Ząbki municipal office, there is no current evidence confirming that the location was operating as a registered children’s club.
