Starting in 2026, Polish employees can retroactively include past contract work and self-employment periods toward their official labor seniority, potentially securing extra vacation days and benefits through a new ZUS application process.
New Seniority Calculation Rules
New regulations now encompass employees across all sectors, both public and private. This marks one of the most significant shifts in the labor market, potentially granting many individuals additional vacation days, higher seniority bonuses, or previously unavailable employment benefits.
The change primarily targets those who spent years working on service contracts or operating their own businesses—periods that were previously excluded from formal labor seniority calculations.
Scope of the Reform
The impact is substantial. Recent data indicates that over 1.5 million people in Poland worked under service contracts in 2025, while the number of active businesses exceeds 2.9 million. These groups stand to gain the most, provided they obtain the necessary certification from ZUS.
Contract Work Now Counts
ZUS confirmed that periods covered by pension and disability insurance from service contracts or similar service agreements will now be recognized. For many young professionals who spent years gaining experience on such contracts, this could finally bridge the gap between their actual experience and their formal employment record.
Access to Higher Vacation Entitlements
The most immediate benefit concerns vacation time. Employees who reach the 10-year seniority threshold are entitled to 26 days of annual leave instead of 20. By documenting previous contract work or self-employment, many staff members may find themselves suddenly crossing this 10-year mark.
Self-Employment and Retroactive Validity
The new rules apply to the self-employed, recognizing years of business ownership that were previously ignored when transitioning to a standard employment contract. Crucially, these provisions are retroactive, allowing individuals to include work history from many years ago.
Clarification on Retirement Benefits
ZUS emphasizes that these changes do not affect retirement seniority or calculations. The adjustments are strictly limited to labor rights, such as vacation entitlements, seniority bonuses, and jubilee awards.
Application Procedure and Deadlines
These benefits are not applied automatically. Employees must request a certificate via their eZUS account, fill out the dedicated seniority application, and submit it to their employer. If documentation is missing due to age, alternative proof of employment may be presented.
Employees have 24 months to document these periods. For the public finance sector, the clock began on January 1, 2026; for private sector employees, the deadline starts from May 1, 2026.
