Former FBI Chief Comey Charged with Threatening Trump on Instagram

James Comey, ex-director of the FBI, faces charges alleging he threatened former President Trump through a cryptic Instagram post.

Instagram Post at the Center of the Case

The case revolves around a May 15, 2023, Instagram post by Comey featuring a photo of seashells arranged to form the numbers 86 and 47. The number 47 allegedly references Donald Trump, who was the 47th President of the United States.

“86” is slang that can signify removal or cancellation, and in common usage, can mean killing someone. Comey captioned the post, “Nice shell arrangement during my beach walk,” but it was quickly removed following comments suggesting a threat.

Comey’s Explanation and the Charges

Comey claimed the seashells were a “political message” but denied intending to incite violence, stating he didn’t realize it could be interpreted as a call for assassination. He has been charged with two counts related to threatening the President.

Prosecutors argued a reasonable person could interpret the photo as a “serious expression of intent to cause harm” to President Trump. No additional evidence supporting the charges was presented in the indictment.

Trump’s Reaction and Previous Disputes

President Trump stated, “Even a child knows what that means,” referring to the 8647 combination, and asserted Comey was “calling for the assassination of the President.” He further criticized Comey’s competence, suggesting he knew the meaning and acted deliberately.

Trump previously fired Comey during his first term due to the FBI investigation into Russian ties to Trump and his campaign.

Arrest Warrant and Broader Context

Acting Attorney General Todd Blanche announced an arrest warrant was issued for Comey. He noted similar charges have been filed against others for making threats against Trump, as well as his immigration advisor Tom Homan and former President Joe Biden.

Investigation and Prior Allegations

The temporary head of the prosecution declined to disclose the evidence investigators possess to prove Comey’s intent, but stated the case wasn’t prompted by the recent attempted attack on Trump. Trump has long called for Comey’s prosecution.

In September of last year, Comey was charged with allegedly lying in congressional testimony, but the charges were dismissed after a federal court ruled the official appointed by Trump to bring the charges was not authorized to do so.

Political Interference in the Case

Lindsey Halligan, a former lawyer on Trump’s team, was appointed to bring the charges shortly after Trump fired a federal prosecutor in Virginia who opposed charging Comey due to lack of evidence. Similar charges against Letitia James, the New York Attorney General, were also dismissed for the same reason.
