Application to the Supreme Court: Judge’s Immunity Questioned

The prosecutor has submitted an application to the Supreme Court seeking to remove Judge Łukasz Piebiak’s judicial immunity so that he can be charged with offenses such as court fraud and use of forged documents.

Will and Apartment Worth 475,000 PLN

The alleged scheme concerned a 38‑square‑meter apartment on Kochanowskiego Street in Warsaw, appraised at 475,000 PLN. In May 2023, Piebiak filed at the Warsaw‑Żoliborz District Court for the opening and publication of a handwritten will of former resident N. M., in which he claimed himself as sole heir. The city of Warsaw, as potential recipient of the property due to lack of heirs, was involved.

Experts: The Will Was Not Written by the Deceased

Court‑appointed graphic experts examined the will and concluded that neither the content nor the signature could have been produced by N. M. A second expert, already engaged in the ongoing prosecutor investigation, reached similar conclusions based on comparative samples from various institutions. They could not pinpoint who forged the document but noted that evidence would require samples of the suspect’s handwriting.

Social Worker Testimony

Investigations revealed that N. M. had no close family or support network. A social worker testified that she never mentioned heirs and only once referred to her husband’s nephew, Łukasz Piebiak. The prosecutor’s report notes that Piebiak had personal contact with N. M. only once.

What Next for the Judge?

The prosecutor’s message says that the evidence indicates that Piebiak acted with intent to commit court fraud. If the Supreme Court lifts his immunity, charges can be formally presented and handwriting samples taken. Depending on further forensic analysis, the charges may be extended to include the falsification of a handwritten document.
