Polish Prosecutor’s Office Seeks Removal of Arkadiusz Myrcha’s Immunity

The Prosecutor General’s Office has submitted a formal request to the Sejm to waive the parliamentary immunity of Arkadiusz Myrcha regarding an alleged violation of electoral silence laws during the 2025 presidential election.

Request Submitted to the Sejm

The police have submitted a motion to the Sejm to strip Arkadiusz Myrcha of his parliamentary immunity. Anna Adamiak, spokesperson for the Prosecutor General, confirmed the office is acting only as the transmitting authority for the request, as it is the only body with the power to initiate such proceedings.

Alleged Violation of Electoral Silence

The case concerns a misdemeanor under Article 498 of the Electoral Code, which prohibits campaigning between the end of the election campaign and the conclusion of voting. The incident occurred during the 2025 presidential election when a graphic endorsing Rafał Trzaskowski was posted to the politician’s social media profile after the start of the electoral silence period. Myrcha subsequently issued an apology, attributing the post to a technical error in loading the graphics.

Political Origins of the Complaint

The notification regarding the potential breach was submitted by PiS MP Dariusz Matecki. In a statement on social media, Matecki accused the Deputy Minister of Justice of deliberately violating the law and attempting to influence the election results illegally.

Parliamentary Procedure for Immunity

The Sejm will now evaluate the motion to strip the MP of his immunity. To approve the request and allow the politician to be held accountable, an absolute majority of votes is required in the presence of at least half of the statutory number of deputies.
