Prosecutors Seek 20-Year Sentence for Łukasz Żak in Trasa Łazienkowska Case

Following the conclusion of the trial on Monday, July 13, prosecutors have requested a 20-year prison sentence for Łukasz Żak, the driver responsible for the fatal high-speed collision on Warsaw’s Trasa Łazienkowska.

The Prosecution’s Case

Prosecutor Katarzyna Niemiec-Rudnicka argued that there are no mitigating circumstances in the case of Łukasz Żak. The defendant, who has a history of driving offenses, drug-related convictions, and multiple violations of court-ordered driving bans, chose to drive while intoxicated after consuming half a bottle of vodka.

The prosecution highlighted that Żak drove at over 200 km/h in the city center, fled the scene without checking on his passengers, and attempted to intimidate witnesses while in custody. Consequently, the prosecution requested a 20-year sentence, a lifetime driving ban, and significant financial restitution for the victim’s family.

Testimony from the Victim’s Widow

The widow of the 37-year-old victim, who died in the crash, called for the verdict to serve as a social warning. She expressed her desire for justice and noted that the defendants displayed a lack of remorse throughout the trial, acting as if the court proceedings were a social occasion.

The Defense Position

Defense attorney Izabela Ławińska argued that public outrage has unfairly shaped the perception of the defendant, stripping him of the presumption of innocence. She emphasized that while the defendant’s actions caused the accident, the court must remain a place where law prevails over public opinion.

Case Background and Verdict Timeline

The crash occurred on September 15, 2024, when a Volkswagen driven by a heavily intoxicated Żak struck a Ford, killing one man and injuring three others, including two children. Investigators estimate Żak was traveling at 226 km/h. Judge Maciej Mitera has scheduled the final verdict for July 16.
