Demolishing a Wall in Your Apartment: One Mistake Carries Severe Consequences

Removing partition walls in residential blocks does not automatically require construction permits, but mistaking a load-bearing element for a simple divider can lead to severe structural damage and legal penalties.

Can You Demolish a Partition Wall in a Large-Panel Block?

Demolishing a partition wall in a large-panel apartment building is permitted, but you must first ensure the planned work targets a true partition rather than a structural building component. In large-panel blocks, a mistake can have far more serious consequences than merely fixing a poorly executed renovation. Current legal interpretation dictates that simply demolishing a partition wall inside an occupied residential unit generally does not require a construction permit or notification to the architectural and construction administration authority.

Apartment owners looking to combine two rooms, open a kitchen to the living room, or alter their layout do not automatically need to initiate a building permit procedure. However, the exact building element slated for removal is the decisive factor.

Legal Status of Partition Walls

The General Office of Building Control clarified in February 2025 that constructing, demolishing, or altering partition walls within a designated residential unit in a commissioned building does not constitute reconstruction, nor is it considered a construction work or renovation under the law. In such cases, Construction Law regulations do not mandate obtaining a building permit.

This is a significant clarification countering the frequently repeated claim that any intervention in an apartment’s wall layout requires prior official approval. For standard partition walls located entirely inside the premises, the situation is different.

Partition Wall vs. Load-Bearing Wall

This does not mean every wall in an apartment can be safely removed without prior documentation review. Source material rightly emphasizes the necessity of confirming whether a partition is genuinely non-structural.

The greatest danger is treating a structural element like a regular room divider. Load-bearing walls carry loads and form part of the building’s structure. Removing them, cutting a large opening, or significantly weakening them can compromise the safety of not just one apartment, but neighboring units as well.

Special caution is warranted in large-panel blocks due to their specific construction systems. Walls should not be classified based solely on their appearance, the sound they produce when tapped, or a single universal thickness measurement.

Technical Documentation and Professional Consultation

The primary source of information should be the technical documentation of the building and the apartment. If owners lack this, they should contact the housing cooperative, community, or property manager. When in doubt, consulting a qualified construction professional, primarily a structural engineer, is the appropriate step.

Beginning demolition just to find out what kind of wall you are dealing with mid-work is extremely dangerous. If you suspect an element is structural, all work must stop immediately.

Cooperative Consent and Common Property

The absence of a building permit requirement does not automatically mean all other formalities disappear. These are two separate matters.

For separately owned apartments, the key issue is whether the intervention remains restricted to the owner’s private space. The Ownership of Premises Act defines common property as the land and parts of the building and devices that do not serve exclusively the use of individual apartment owners.

If a renovation interferes with common property, the structure, ceilings, vertical utility risers, or other elements serving the entire building, the legal situation differs entirely from dismantling a standard internal partition.

The legal form of apartment occupancy also matters. In a housing cooperative, you must check current renovation bylaws and rules governing work within units. Cooperatives or administrators may require notification, technical documentation, or specialist opinions, especially when doubts exist regarding structural or utility impacts.

Therefore, before renovation crews arrive, owners should submit a description of planned work to the manager in writing to establish building-specific requirements and prevent disputes after demolition begins.

Large-Panel Buildings and Wall Thickness

Simplified online advice suggests that simply measuring a wall is enough—thick means load-bearing, thin means partition. This method is unreliable, particularly in large-panel construction.

Individual housing estates were built using various systems, and structural elements do not share identical parameters everywhere. Decisions to demolish should never rely solely on wall measurements.

Checking structural blueprints and management documentation is far safer. A specialist can additionally assess ceiling supports, structural paths, and the actual function of the partition.

A wall’s location is also not definitive. Finding a wall between a kitchen and a room or inside an apartment does not automatically rule out a structural function.

Hidden Utilities and Ventilation Risks

Even correctly identified partition walls may conceal utility lines. Before demolition, verify whether electrical wiring, telecommunication cables, plumbing, sewage pipes, or other technical elements run through the wall.

The base material notes that damaging such utilities brings extra costs and complications extending beyond a single apartment’s renovation.

Utilities forming part of the building’s common systems require special attention. Do not assume everything behind plaster inside an apartment belongs exclusively to the owner.

Before starting work, evaluate whether planned changes will disrupt ventilation. This is crucial when combining kitchens with other rooms or in apartments featuring gas-fueled appliances.

Step-by-Step Guide to Safe Demolition

The correct sequence of actions begins before any hammers or power tools appear. First, definitively establish the wall’s function, check building documentation and utility paths, and verify the property manager’s rules.

If documentation leaves doubts, seek help from qualified professionals. Only after confirming the wall is non-structural and its removal does not impact structures or common areas should you organize demolition.

Work areas must be properly secured, utilities disconnected or safeguarded, and the wall dismantled in a controlled manner. Debris disposal must also be planned in advance. Dumping renovation waste haphazardly near municipal bins is improper.

Post-demolition, inspect utilities and adjacent elements before leveling floors, ceilings, and walls to finish the newly created space.

Load-Bearing Wall Demolition Procedures

The situation changes fundamentally when planned work involves structural elements. The rules governing standard partition walls do not apply to load-bearing walls.

Interfering with structural elements can be classified differently under Construction Law, requiring project documentation and administrative formalities alongside issues of common property interference.

This is why precise scoping is necessary before renovating. The phrase “demolishing a wall” can mean a simple interior redesign or a severe structural intervention affecting an entire building.

Checklist Before Demolishing a Partition Wall

Before remodeling, owners must confirm wall types via technical documentation, map utility lines, review cooperative or community rules, and check for impacts on building common areas.

If any answers remain unclear, do not begin demolition based on assumptions. In multi-family blocks, erroneous decisions can directly impact neighbors.

Removing a standard internal partition without permits carries no automatic fines if it avoids structural interference. However, unpermitted alterations to load-bearing elements violate Construction Law and incur financial penalties.

Penalties and Financial Consequences of Unpermitted Demolition

As a misdemeanor, courts can levy fines ranging from 20 to 5,000 PLN for unpermitted structural work. Separately, building oversight can halt operations, order documentation, mandate repair work, or require restoring apartments to legal compliance.

In practice, financial consequences extend far beyond basic fines, encompassing structural engineering fees, expert opinions, building stabilization, mandated repairs, and compensation for damages in other apartments.

Neighbor compensation lacks a statutory 5,000 PLN cap, depending instead on actual damage values. In extreme cases threatening life or property, criminal consequences may apply alongside administrative penalties.
