Prosecutors Refuse to Investigate Sikorski for Calling Macierewicz a “Lunatic”

The Warsaw District Prosecutor’s Office has declined to launch an investigation into Radosław Sikorski’s parliamentary remarks regarding Antoni Macierewicz, citing a lack of overriding public interest or rule-of-law necessity.

Prosecution Declines Intervention

On June 10, the Warsaw District Prosecutor’s Office issued a formal decision refusing to prosecute Foreign Minister Radosław Sikorski for defamation. Spokesman Piotr Antoni Skiba explained that since defamation is a private prosecution offense, authorities only intervene if the public interest or the rule of law is at stake. The prosecutor concluded that these conditions were not met in this instance.

A History of Inaction

Prosecutors noted that although Antoni Macierewicz is capable of pursuing his own legal remedies, he has failed to file a private complaint against Sikorski. The office highlighted that despite the Foreign Minister repeatedly using the term “świr” (lunatic) to describe Macierewicz in recent years, the PiS lawmaker has taken no legal action.

Mutual Breach of Parliamentary Standards

Spokesman Piotr Antoni Skiba criticized both parties, stating that Sikorski’s rhetoric violates standards of civil discourse and diminishes the dignity of the state. Simultaneously, the prosecutor’s office emphasized that Macierewicz’s own behavior during parliamentary sessions, which triggered the exchange, also fails to align with the gravity expected of a state official.

Sikorski’s Reaction

Following the prosecutor’s announcement on June 16, Radosław Sikorski commented on social media platform X, expressing regret that the matter would not be heard in court. He suggested that a formal medical board might have finally clarified whether Macierewicz is “sick or an agent.”

The Parliamentary Context

The controversy stems from a March 13 parliamentary session concerning the EU SAFE program. During the debate, Sikorski questioned Macierewicz regarding his past tenure as Minister of National Defense and his role in the subcommittee investigating the Smolensk disaster, specifically asking about the status of Caracal helicopter contracts and allegations regarding Mistral warships.

Factual Discrepancies

The government’s cancellation of the 2015 Caracal helicopter purchase occurred after the PiS party assumed power. Furthermore, in 2016, Macierewicz asserted that Egypt sold Mistral ships to Russia for one dollar—a claim later identified by media outlets as Russian propaganda.
