Stalled Appointment and Formal Request
Sławomir Patyra was elected by the Sejm on June 11 with 235 votes to succeed Andrzej Zielonacki, whose term expired on June 28. Despite being ready to take his oath immediately, the inauguration has not yet occurred.
On July 3, Patyra filed an official letter with the Presidential Chancellery requesting the scheduling of his swearing-in. Presidential spokesperson Rafał Leśkiewicz has not responded to inquiries regarding the timing of the ceremony.
Political Resistance and Precedent
Jarosław Kaczyński, leader of Law and Justice (PiS), has publicly questioned Patyra’s qualifications, suggesting the president has a right to deliberate. Kaczyński indicated that the president might follow the precedent set with other recent judicial appointees.
The appointment process is complicated by broader disputes regarding the Constitutional Court. While some judges were sworn in by the president in April, others took their oaths in the Sejm, leading to a conflict between the government and Court President Bogdan Święczkowski.

The dispute has reached the international stage, with four affected judges filing complaints with the European Court of Human Rights. The Polish Ministry of Foreign Affairs has argued in favor of the judges’ legitimacy, while President Święczkowski maintains that they are not yet authorized to perform their duties.
