Your Right to Reclaim Lost Vacation Time
Food poisoning, injuries, or sudden illnesses can ruin a long-awaited holiday. Many employees mistakenly believe that once their vacation starts, they must accept the loss of these days even if they fall ill. This is a significant error that costs workers their rightful rest.
According to Article 166 of the Labor Code, illness during a vacation is not considered time spent resting. Employers are legally obligated to return any vacation days lost to illness or quarantine, regardless of their own preference.
How Automatic Leave Interruption Works
When a doctor issues a medical certificate, your vacation is automatically interrupted by law. The definition of a vacation is time meant for regeneration; if you are bedridden or hospitalized, that objective is not met. Consequently, your status changes from a vacationer to a patient on sick leave.
These days are not lost; they are simply moved to a different, mutually agreed-upon period. The employer cannot refuse this process, as the law explicitly protects the employee’s right to recover their lost leave.
Practical Examples: Anna, Tomasz, and Karolina
If you fall ill mid-trip, like Anna, the days covered by your medical certificate are treated as sick leave, and your remaining vacation days are preserved for later. If you are injured before your trip begins, like Tomasz, your entire leave is postponed until you have recovered.
However, you cannot unilaterally extend your vacation. If your sick leave ends, you are legally required to return to work. Trying to “add on” the lost days without coordination with your employer can be grounds for immediate termination.
Handling Illnesses Abroad
Falling ill outside of Poland is more complex, as foreign doctors do not issue the electronic medical certificates that sync directly with the Polish social security system. In these cases, employees must be diligent and proactive in securing proper documentation to ensure they can reclaim their time off upon return.
